Artwork and Tribute Video Terms and Conditions
These Artwork and Tribute Video Terms and Conditions (“Terms”) govern all custom artwork, tribute video, and related product orders placed with Chad Hawkins Tributes, a brand and business operation of Chad Hawkins Art, Inc. (“Company”). For purposes of these Terms, references to “Chad Hawkins Tributes” mean Chad Hawkins Art, Inc. operating through its Chad Hawkins Tributes brand together with its officers.
1. Services Provided
Client may be purchasing custom artwork, a tribute video, or both. Custom artwork may include a hand-drawn portrait, drawing, print, or related artistic product. Tribute video services may include a custom video tribute created from materials submitted by Client.
Client understands that Chad Hawkins Tributes creates custom artistic and tribute products using materials submitted by Client, which may include photographs, video clips, audio recordings, written memories, names, dates, music requests, personal details, family information, and other related materials.
Client understands that the materials submitted by Client are the Client’s input for the project.
2. Creative and Artistic Discretion
Chad Hawkins Tributes provides a creative and artistic service. Client understands and agrees that all final creative, artistic, drawing, editing, sequencing, pacing, music, transitions, captions, effects, enhancements, cropping, composition, style, tone, and production decisions are made solely by Chad Hawkins Tributes.
Chad Hawkins Tributes will make reasonable efforts to treat all people, families, memories, images, voices, stories, and submitted materials with dignity and respect.
Client understands that Chad Hawkins Tributes is not required to include every submitted item and may include, exclude, shorten, enhance, rearrange, modify, interpret, or omit materials at its discretion.
3. No Drafts, Reviews, or Revisions
Client understands that custom artwork and tribute videos are completed at Chad Hawkins Tributes’ discretion and are not subject to Client preview, approval, revision, re-editing, redrawing, redesign, correction, final review, or modification unless otherwise agreed in writing.
Delivery of the completed artwork, tribute video, or related product fulfills the creative service purchased. Additional edits, changes, alternate versions, redraws, re-edits, or modifications are not included and may be refused or may require additional fees at the sole discretion of Chad Hawkins Tributes.
4. Permission to Use Submitted Materials
Client represents and warrants that Client owns, controls, or has obtained all necessary rights, permissions, and authority to submit all photographs, videos, audio recordings, voice recordings, written materials, names, likenesses, and other content provided to Chad Hawkins Tributes.
Client gives Chad Hawkins Tributes permission to copy, edit, crop, enhance, arrange, reproduce, display, draw from, reference, interpret, and otherwise use the submitted materials for the purpose of creating and delivering the custom artwork, tribute video, and related tribute products.
5. Responsibility for Third-Party Rights
Client is solely responsible for ensuring that all submitted materials may legally be used, including any photographs, video clips, audio recordings, music, written text, poems, quotes, artwork, logos, copyrighted materials, names, images, likenesses, voices, or appearances of any person.
Client agrees not to submit any materials that violate another person’s or entity’s rights, including copyright, trademark, privacy rights, publicity rights, contractual rights, or any other legal rights.
Client agrees to indemnify, defend, and hold harmless Chad Hawkins Tributes, Chad Hawkins, and any related employees, successors, and assigns from any claims, demands, losses, damages, liabilities, costs, or expenses, including reasonable attorney fees, arising out of or related to Client’s submitted materials, Client’s lack of authority to grant permission, or any claim that the submitted materials violate the rights of another person or entity.
6. Minors and Deceased Individuals
If submitted materials include a minor, Client represents that Client is the parent or legal guardian of the minor or has obtained permission from the minor’s parent or legal guardian.
If submitted materials include a deceased individual, Client represents that Client has the legal authority, family authorization, or necessary permission from the appropriate right holder, estate representative, heir, executor, successor, licensee, or authorized family member to allow Chad Hawkins Tributes to use that deceased individual’s name, image, likeness, voice, appearance, and personal materials in the custom artwork, tribute video, and related products.
7. Music and Copyrighted Materials
Client understands that copyrighted music, poems, images, video clips, artwork, logos, or other protected materials may require permission or licensing.
Chad Hawkins Tributes may refuse to use any material that appears to create copyright, licensing, privacy, publicity, or legal concerns.
